Terms & Conditions

These Terms & Conditions ("Terms") are an agreement between you and Alski Solutions SL Limited ("Xendaq", "we", "us") governing your access to and use of the Xendaq web and mobile platform for HR, payroll, attendance, leave, tasks, procurement, approvals, reports, notifications, and related workforce operations (the "Service"). By creating an account, ticking the acceptance box, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. The Service
Xendaq provides a multi-company, cloud-based workforce management platform. Features available to you depend on your plan and the modules enabled for your workspace. We may add, change, or remove features to improve the Service.
2. Accounts and Eligibility
You must provide accurate registration details and are responsible for your account, your users, and all activity under your workspace. You must keep credentials confidential, use the Service only for lawful business purposes, and ensure that everyone you invite complies with these Terms. The person accepting these Terms represents that they are authorized to bind their organization.
3. Customer Data and Privacy
You retain ownership of the data your organization submits to the Service ("Customer Data"). You are responsible for the accuracy and lawfulness of Customer Data, including obtaining any consents required to process employee and personal information (such as attendance or location data). We process Customer Data as described in our Privacy Policy and only to provide and support the Service. You grant us the limited rights needed to host, process, and display Customer Data for that purpose.
4. Acceptable Use
You agree not to misuse the Service, including by: accessing another tenant's data; attempting to breach security, tenant isolation, or access controls; uploading unlawful, infringing, or malicious content; reverse engineering the platform except as permitted by law; reselling the Service without authorization; or using it to violate any applicable law or the rights of others.
5. Fees, Trials, and Billing
Paid plans are billed per your selected plan, staff quantity, and billing cycle. Free trials, where offered, give time-limited access and may convert to a paid plan or expire. Online payments are processed by our payment provider (Monime); by paying, you also accept that provider's terms. Fees are exclusive of applicable taxes and, except where required by law, are non-refundable. We may update pricing on notice for future billing periods.
6. Intellectual Property
The Service, including its software, design, and content (excluding Customer Data), is owned by Alski Solutions SL Limited and its licensors and is protected by law. We grant you a non-exclusive, non-transferable right to use the Service during your subscription, subject to these Terms. All rights not expressly granted are reserved.
7. Availability and Support
We work to keep the Service available and secure but do not guarantee uninterrupted or error-free operation. We may perform maintenance, and may suspend access to protect the Service, comply with law, or address non-payment or violations of these Terms. Support is provided through the channels listed below.
8. Disclaimers and Limitation of Liability
The Service is provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by law. Xendaq is a tool to assist your operations; you remain responsible for your business, payroll, financial, and compliance decisions. To the fullest extent permitted by law, Xendaq is not liable for indirect, incidental, or consequential losses, and our total liability for any claim relating to the Service is limited to the fees you paid for the Service in the twelve months before the claim.
9. Termination
You may stop using the Service at any time. We may suspend or terminate access for material breach, non-payment, or as required by law. On termination, your right to use the Service ends. You may request an export of Customer Data before termination; after a reasonable retention period we may delete Customer Data in line with our Privacy Policy.
10. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on this page with a new effective date, and continued use of the Service after changes take effect means you accept the updated Terms.
11. Governing Law
These Terms are governed by the laws of the Republic of Sierra Leone, and the courts of Sierra Leone have jurisdiction over any dispute, without prejudice to any mandatory rights you may have under applicable law.
